There is no denying it, the distant sound of jingling bells tells us the festive season is well on its way. For many, it’s the time of year when friends and families come together to eat, drink, and be decidedly merry. However, for those running licenced premises, this period brings heightened compliance measures due to the increase of festive footfall.
So before Santa puts you on the naughty list, we have provided a festive licencing checklist so you can ensure your ducks (or reindeers) are in a row before the magical mayhem commences.
Check Your Licence List – and Check It Twice
Take a look at your Premises Licence and Operating Plan (particularly the ‘seasonal variations’ section) to make sure your activities still match what’s approved by your Licencing Board. If you’re stepping outside your usual remit, you might need an Occasional Licence if your Licencing Board does not automatically grant the seasonal variations you want to host.
If you’re planning to add a little Christmas sparkle and extend your opening hours for those festive late-night revellers and Christmas party crowds, then you may need an Extended Hours Application submitted in good time to your Licensing Board.
Each Licensing Board takes its own approach to seasonal variations and extended hours. Some grant these automatically, while others require a formal application, so it’s worth checking your local Board’s policies before the festivities begin and submitting any applications before the sleigh bells start ringing.
Ensure Every Elf Is Fit and Proper
Temporary seasonal staff are the unsung heroes of Christmas hospitality – but don’t forget your legal obligations.
Every person who sells alcohol must be properly trained in line with the Licensing (Scotland) Act 2005, and records of that training should be available for inspection by Licencing Standard Officers (otherwise known as Santa’s Little Helpers for this purpose).
Similarly, don’t overlook your Personal Licence Holders or Designated Premises Manager. If any are due to expire soon or require to be varied, get those applications in ahead of time before expiry. No one wants to find their licence has lapsed on Christmas Eve!
Don’t Get Claus-trophobic!
While the festive season brings everyone together, make sure that you have enough room for them all and your licence capacity is adhered to.
Overfilling your venue might seem like a bright idea, but it could leave you on the naughty list with the aforementioned Santa’s Little Helpers… and Police Scotland.
